Louisiana State poster updated to revise Independent Contractor.

The Louisiana Independent Contractor poster has been updated to reflect a correction. The agency made the correction that an employee is entitled to Workers’ Compensation benefits for on-the-job injuries. This is a mandatory change.

Statutory language regarding this posting: Employee Rights – If you are an employee, you are entitled to workers’ compensation benefits for on-the-job injuries.

Effective Date: September 2012

The new poster will be available October 12, 2012.

New Posting: Louisiana Independent Contractor Poster

Louisiana State poster revised to include Independent Contractor.

The Louisiana Workforce Commission has released a new poster that must be posted by all employers regarding the criteria for determining independent contractor or employee status in the workplace. The poster lists the three criteria that must be met for a worker to be classified as an independent contractor. The poster also indicates the penalties for misclassifying a worker as an independent contractor. This is a mandatory change.

 Statutory language regarding this posting: Every employer shall post in a prominent and accessible location at each of its business premises a poster provided by the administrator that describes the responsibilities of independent contractors to pay taxes as required by state and federal laws, the rights of employees to workers’ compensation and unemployment benefits, protections against retaliation, and the penalties if the employer fails to properly classify an individual as an employee. The notice shall also contain contact information for individuals to file complaints or obtain information regarding employment classification.

Louisiana Earned Income Credit Poster Change

February 15, 2012

Louisiana State poster revised to update Earned Income Credit.

The Louisiana Earned Income Credit poster has been updated to reflect the 2012 income limits for eligibility and notice of the elimination of the advance payments of the Earned Income Tax Credit to workers after December 31, 2010. 

Statutory language regarding this posting: Based on the recent IRS ruling, if an individual makes $45,000 or less, an employer should notify you at the time of hiring of the potential availability of Earned Income Tax Credits if you meet the 2012 income limits for eligibility. Poster contains the details for eligibility.

Effective Date: March 2012

Louisiana Child Labor Change

September 26, 2011

Louisiana State poster revised to update Child Labor change.

The Louisiana Child Labor poster has been updated to clarify the allowable hours and industries youths 14 and 15 years of age are permitted to work outside of school hours.

Statutory language regarding this posting: Youths 14 and 15 years old may work outside school hours in various non-manufacturing, non-mining, non-hazardous jobs under the following conditions, if no more than:
     * 3 hours on a school day or 18 hours in a school week;
     * 8 hours on a non-school day or 40 hours in a non-school week.
Also, work may not begin before 7 a.m. or end after 7 p.m., except from June 1 through Labor Day, when evening hours are extended to 9 p.m.

Effective Date: October 2011
The new poster will be available October 18, 2011.

Louisiana Child Labor Change

August 29, 2011

Louisiana State poster revised to update Child Labor change.

The Louisiana Child Labor poster has been updated to reflect changes to the restricted work hours and work days for minors under the age of 16 during the summer beginning on June 1 to Labor Day.

Statutory language regarding this posting: No minor under the age of 16 years shall be employed more than 8 hours in any one day, nor more than six consecutive days in any one week, nor more than 40 hours in anyone week from June 1 through Labor Day. No minor under 16 years of age who has graduated from high school shall be employed, or permitted, or suffered to work between the hours of 7:00 pm and 7:00 am, except from June 1 through Labor Day, at which time the permissable hours are extended to 9:00 pm.

Effective Date: September 2011
The new poster will be available September 19, 2011.

The Louisiana Discrimination posters have been updated to reflect additional information.  The Louisiana Workforce Commission has added that “if you believe you have been discriminated against, please contact the Louisiana Commission on Human Rights” with a phone and web contact.  This is a mandatory change.


Louisiana Earned Income Change

Louisiana State poster revised to update Earned Income Credit change.

1/22/10 – The Louisiana Earned Income Credit poster has been updated to reflect the 2010 Earned Income Tax limits and the temporary increase in the Earned Income Tax Credit for workers with three or more qualifying children provided under The American Recovery and Reinvestment Act (ARRA). This is a mandatory change.
